These Terms of Service ("Terms") set out the legally binding agreement between gaitherhunter ("we", "us", "our")—a Brighton-based casual women’s clothing brand specializing in co-ord sets, bottoms, dresses, and tops—and you ("Customer", "you"). These Terms govern your access to and use of the gaitherhunter website (the "Website"), related digital services, and the purchase of our apparel products (the "Products"). By accessing the Website, creating an account, or placing an order, you confirm that you have read, understood, and unconditionally agree to be bound by these Terms, together with our Privacy Policy and any supplementary guidelines referenced herein. If you do not accept any provision of these Terms, you must immediately cease all use of our services and refrain from purchasing any Products.
1. Brand Commitment & Service Scope
gaitherhunter is dedicated to providing stylish, comfortable casual apparel that caters to everyday wear, with four core product lines: coordinated co-ord sets, versatile bottoms (trousers, skirts, shorts), elegant dresses, and tailored tops. Rooted in Brighton’s vibrant fashion culture, our services include: delivering category-specific Product details (such as co-ord set matching standards, bottom fit precision, dress fabric durability, and top silhouette guidelines) on the Website; processing orders with transparency and proactive updates; enabling secure payment via trusted third-party providers; arranging reliable domestic and selected international delivery; and offering specialized after-sales support for product-specific queries.
We reserve the right to update our Product collection, optimize service processes, or upgrade Website functionalities at our sole discretion. Such adjustments shall not affect the validity of existing contracts for fully paid and confirmed orders. We strive for accuracy in all Product information (descriptions, imagery, sizing, pricing); however, minor variations—including color discrepancies from screen calibration, slight fit differences in bottoms, or top stitching nuances from manual production—are inherent to apparel manufacturing and do not constitute product defects.
2. Customer Eligibility & Core Duties
You must be 18 years of age or older to use our services or purchase Products. Minors (under 18) may only access our services with the prior written consent of a parent or legal guardian, who shall assume full liability for all transactions, returns, and disputes arising from the minor’s use of our services.
You agree to provide truthful, accurate, and up-to-date information when registering an account (if applicable) or placing an order, including your full legal name, valid contact details, complete and accessible delivery address, and legitimate payment information. You shall bear sole responsibility for any losses, delivery delays, or disputes caused by false, incomplete, or outdated information provided by you.
You are prohibited from engaging in any conduct that violates these Terms or applicable UK laws, including but not limited to: (a) Submitting fraudulent orders, using stolen or unauthorized payment methods, or initiating improper chargebacks; (b) Tampering with the Website’s security systems, uploading malicious content, or disrupting the normal operation of our services; (c) Reselling, distributing, or commercializing our Products (co-ord sets, bottoms, dresses, tops) without our explicit written authorization; (d) Infringing upon our intellectual property rights (e.g., copying co-ord set designs, bottom cuts, or brand logos) or violating the privacy of other Customers.
3. Account Security & Usage Rules
Account registration is optional for one-time purchases but required to access personalized features, including order tracking, saved delivery addresses, purchase history, and category-specific promotional offers. If you create an account, you are solely responsible for safeguarding your login credentials (username and password) and all activities conducted under your account. You must notify our customer service team immediately upon detecting any unauthorized access to your account or potential security breaches.
We implement industry-standard security measures—including end-to-end data encryption, secure login authentication, and regular security audits—to protect your account information. However, we shall not be liable for any losses resulting from your failure to protect your credentials, or security breaches caused by third-party factors (e.g., phishing attacks, external malware) beyond our reasonable control.
4. Order Validation & Contract Formation
Submitting an order via the Website constitutes a formal offer by you to purchase the specified Products in accordance with these Terms. We will send an automated "Order Notification" email to your provided address within 1 hour of receiving your order—this email confirms order receipt only and does not form a binding contract.
A legally binding contract between you and us is established only when we issue a "Order Confirmation & Fulfillment Details" email. This email verifies Product availability, confirms successful payment processing, and outlines the expected dispatch timeline and tracking information. We reserve the right to reject or cancel an order at our sole discretion if: (a) Any ordered Product is out of stock or permanently discontinued; (b) There is a material error in pricing, description, or imagery; (c) We have reasonable grounds to suspect fraud or unauthorized payment; (d) The delivery address is invalid, incomplete, or inaccessible to our logistics partners.
If we cancel a paid order, we will refund the full amount to your original payment method within 2 business days, with no deductions. You may cancel an unshipped order by contacting our customer service team with your order number; once dispatched, cancellation is unavailable, and you must follow our returns process (Section 7).
5. Pricing, Payment & Tax Regulations
All Product prices are quoted in British Pounds (GBP) and include Value Added Tax (VAT) in compliance with UK tax legislation. Shipping costs are calculated based on delivery location, order weight (accounting for co-ord sets and structured tops), and selected shipping method, with clear itemization at checkout for your confirmation prior to payment.
We may adjust Product prices due to changes in raw material costs (e.g., dress fabric, bottom material), market fluctuations, or promotional activities; however, adjusted prices do not apply to orders for which an Order Confirmation & Fulfillment Details email has already been issued. Full payment must be completed at checkout via our accepted secure methods (Visa, Mastercard, PayPal). All payments are processed through encrypted third-party gateways, and we never store full payment card details. If your payment is declined, your order will not be processed, and we will notify you promptly to assist with resolution.
6. Delivery Arrangements & Risk Transfer
We offer delivery to addresses across the UK and selected international destinations (full list available on our "Shipping & Delivery" page). Estimated delivery timeframes: (a) UK Mainland: 1–3 business days post-dispatch; (b) UK Highlands & Islands: 3–5 business days post-dispatch; (c) International: 6–14 business days post-dispatch (subject to customs clearance).
Orders are dispatched within 2 business days of confirmation. We take special care in packaging—preserving co-ord set matching components, protecting bottom hems, and preventing top creasing during transit. A shipping notification with a unique tracking number will be sent once dispatched, enabling real-time delivery monitoring. We cannot guarantee exact delivery times and shall not be liable for delays caused by unforeseen circumstances (courier strikes, extreme weather, customs delays, public holidays).
You are responsible for ensuring the delivery address is accurate and accessible. Failed deliveries due to incorrect addresses may incur a re-delivery fee. Risk of loss, damage, or theft of Products transfers to you upon courier confirmation of delivery (including safe locations or authorized recipients). Title to Products remains with us until full payment is received.
Upon delivery, inspect the packaging and Products immediately—check co-ord sets for completeness, bottoms for fit consistency, dresses for hem damage, and tops for stitching issues. Document any issues with photographs and contact our customer service team within 72 hours to file a claim. Delayed notifications may hinder claim processing.
7. Returns, Refunds & Exchanges (Category-Specific)
You may return eligible Products for a full refund or exchange within 30 calendar days of receipt, provided: (1) Products are unused, unwashed, and in original condition (no alterations to bottoms, no damage to co-ord set components, no fraying of dress hems, no snags in tops); (2) All original tags, labels, and packaging are intact; (3) Valid proof of purchase (order number/confirmation email) is provided; (4) Co-ord sets are returned in full (all matching pieces), and detachable accessories are included.
Non-returnable/non-exchangeable Products: (a) Personalized items (tailored bottoms, monogrammed co-ord sets); (b) "Final Sale" items (discounts of 60% or more); (c) Products damaged by improper use/washing (stretched bottoms, faded dresses, pillaged tops, separated co-ord sets); (d) Intimate apparel (unless defective and unopened in original packaging).
To initiate a return/exchange, contact our customer service team via email/phone to obtain a Return Authorization (RA) Number—this must be displayed on return packaging (returns without an RA Number will be rejected). You cover return shipping unless the issue is our fault (incorrect size, defective stitching, wrong product sent), in which case we reimburse reasonable shipping fees post-verification.
Returned Products are inspected within 5 business days, with focus on category-specific conditions. Eligible refunds/exchanges are processed within 8 business days. Refunds are credited to the original payment method; original shipping fees are non-refundable unless we are at fault. Replacement Products are dispatched once returns are approved.
8. Intellectual Property Rights
All intellectual property rights (trademarks, logos, Product designs—co-ord set styles, bottom cuts, dress silhouettes, top patterns—Website content, software) belong exclusively to gaitherhunter or our authorized licensors. You are granted a limited, non-transferable license to access/use the Website for personal, non-commercial purposes only.
Without prior written consent, you may not reproduce, copy, modify, distribute, or exploit our intellectual property—including using Product images for commercial promotion, copying co-ord set designs for production, or reposting Website content. Contact us with evidence if you believe our content infringes your intellectual property.
9. Liability Limitations
To the maximum extent permitted by UK law, gaitherhunter shall not be liable for indirect, consequential, incidental, special, or punitive damages (loss of profits, business opportunities, data, emotional distress) arising from our services or Products, regardless of legal basis (contract, tort, negligence).
Our total liability for direct damages due to breach of Terms or negligence is limited to the total amount paid for the relevant Products. We exclude liability for death/personal injury from gross negligence, fraud, or non-excludable obligations. Minor category-specific variations (bottom fit nuances, top stitching differences) do not constitute liability.
10. Data Privacy & Compliance
We process personal data in strict compliance with the UK General Data Protection Regulation (UK GDPR) and relevant laws. Our Privacy Policy details data collection (contact, payment, order history, size preferences for bottoms and tops), processing purposes, security measures, and your rights (access, correction, deletion, objection). Using our services constitutes consent to these practices.
11. Terms Updates & Enforcement
We may revise these Terms to reflect legal changes, industry standards, or business updates. Updated Terms are posted on the Website with a "Last Updated" date and take effect 14 days after publication. Continued use of our services post-effective date confirms acceptance of revisions. We recommend regular reviews.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of England and Wales. Disputes shall first be resolved via good-faith negotiation. If unresolved within 20 days of initial contact, either party may submit the dispute to the exclusive jurisdiction of England and Wales courts.
